These Terms and Conditions (“Terms”) govern the use of services provided by Chef Clif (“Chef,” “we,” “us,” or “our”) through the website www.chefclif.com (the “Website”) and any direct engagement for private chef, catering, culinary classes, or event services (collectively, the “Services”). By booking or using our Services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.
1. Services
Chef Clif provides private chef experiences, in-home dining, catering, cooking classes, and small events throughout Texas and surrounding areas. Specific details of each Service, including menu, date, time, and location, will be confirmed in writing prior to booking.
2. Booking, Deposits, and Payments
To secure a booking, a deposit equal to 25% of the total agreed fee (“Deposit”) is required. The remaining balance is due no later than the date of service, unless otherwise agreed in writing. Failure to make timely payment may result in cancellation of the booking without refund of the Deposit.
3. Cancellations and Refunds
If the Client cancels more than seven (7) days before the scheduled event, the Deposit will be refunded less any costs already incurred. Cancellations within seven (7) days of the scheduled event will forfeit the Deposit. If cancellation occurs within forty-eight (48) hours of the event, the Client is responsible for the full fee. Chef Clif reserves the right to cancel due to illness, emergency, unsafe kitchen conditions, or circumstances beyond our control (“Force Majeure”). In such cases, any Deposit will be refunded in full or applied to a rescheduled date.
4. Client Obligations
The Client agrees to provide a clean, safe, and functional kitchen with working appliances, water, and electricity. The Client must ensure appropriate access to the premises at the agreed time. Failure to do so may result in cancellation and forfeiture of payment. The Client is responsible for informing Chef Clif of any allergies, dietary restrictions, or special requests at the time of booking.
5. Allergies and Dietary Restrictions
Chef Clif exercises reasonable care to accommodate allergies and dietary needs but cannot guarantee a completely allergen-free environment. The Client assumes all responsibility for communicating any food allergies or sensitivities for themselves and their guests. Chef Clif disclaims liability for any allergic reactions resulting from undisclosed information or cross-contamination.
6. Menu and Ingredient Changes
Menus are finalized at the time of booking but may be adjusted based on ingredient availability, quality, or seasonality. Chef Clif reserves the right to make comparable substitutions when necessary.
7. Travel Fees
Travel within the greater Houston metropolitan area is included. Additional travel fees may apply for events outside this area and will be disclosed before booking confirmation.
8. Photography and Promotion
Chef Clif may take photographs or short videos during events for promotional use, including on the Website and social media platforms. Clients who do not wish to have their event or likeness used for such purposes must notify Chef Clif in writing prior to the event.
9. Limitation of Liability
Chef Clif will perform Services with reasonable skill and care. However, Chef Clif is not liable for indirect, incidental, or consequential damages, including loss of profits, delays, or injuries arising from the Service. In all cases, Chef Clif’s total liability shall not exceed the amount paid for the Service in question.
10. Intellectual Property
All content, materials, logos, and images displayed on the Website are the property of Chef Clif and may not be used, copied, or reproduced without express written consent.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be resolved exclusively in the courts of Harris County, Texas.
12. Amendments
Chef Clif reserves the right to update or modify these Terms at any time without prior notice. The latest version will always be posted on www.chefclif.com.
